Terms of Service

1. What ServiceIQ is — and is not

ServiceIQ is a free, goodwill platform that merely connects people who want help ("Requesters") with people willing to help ("Helpers"), including unpaid neighbors and independently licensed professionals ("Pros"). ServiceIQ is a neutral venue and introduction service only.

ServiceIQ does not: perform, supervise, direct, or control any task; employ or act as agent of any user; vet, certify, license, insure, background-check, or guarantee any user or any outcome; take any fee or commission; or become a party to any agreement between users. Any arrangement to give, receive, or pay for help is solely between the users involved.

2. Independent parties; no employment or agency

Helpers and Pros are independent individuals acting on their own behalf. Nothing here creates an employment, agency, partnership, or fiduciary relationship between ServiceIQ and any user, or between users. Users are solely responsible for their own conduct, taxes, insurance, tools, licensing, and legal compliance.

3. Licensed work — your responsibility

Many tasks — including electrical, plumbing, HVAC/mechanical, gas, roofing, structural, and other regulated trades — may by law be performed only by appropriately licensed, bonded, and insured professionals.

4. Assumption of risk

Helping and being helped carry inherent risks — including property damage, bodily injury, financial loss, and death. By using the Service, each user knowingly and voluntarily assumes all such risks, known or unknown, arising from any contact, task, entry onto property, or transaction facilitated through ServiceIQ.

5. Acceptable use & prohibited conduct (what makes a "bad actor")

You agree not to, and you may be reported, suspended, or removed for any of the following:

Any user may report conduct that violates these rules. ServiceIQ may investigate, suspend, or permanently remove users at its discretion, and may cooperate with law enforcement. Reporting tools do not guarantee a particular outcome, and ServiceIQ is not responsible for user conduct on or off the platform.

6. No warranties ("AS IS")

The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, availability, or that any help will be provided, safe, lawful, or satisfactory. We do not warrant any user's identity, character, skill, or honesty.

7. Release of liability

To the fullest extent permitted by law, each user releases, waives, and forever discharges ServiceIQ and its operators, volunteers, and affiliates from any and all claims arising out of or relating to: any help or transaction; the acts or omissions (including negligence) of any user; any property damage, injury, loss, or dispute; and any interaction between users, on or off the platform.

8. Indemnification

Each user agrees to indemnify, defend, and hold harmless ServiceIQ and its operators, volunteers, and affiliates from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from the user's use of the Service, any help given or received, violation of these Terms or any law, performance of licensed/regulated work, or harm caused to any person or property.

9. Limitation of liability

To the fullest extent permitted by law, ServiceIQ will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, property, or personal injury, even if advised of the possibility. Our total aggregate liability for any and all claims will not exceed the greater of the amount you paid ServiceIQ in the prior 12 months (for a free service, $0) or USD $100.

10. Payments between users

ServiceIQ charges nothing and processes no payments. Any payment or tip for a Pro's work is arranged and exchanged directly between users and is entirely their responsibility, including taxes and refunds.

11. Eligibility & accounts

Users must be at least 18, provide accurate information, and use the Service lawfully and in good faith. ServiceIQ may suspend or remove any user at its discretion.

12. Privacy

We use the information you provide (such as name, phone, email, and location) only to connect users and to compute anonymized, aggregate statistics. We do not sell personal data. Phone and email are shared with another party only when you choose to share them. See our Privacy Policy.

13. "Good Samaritan" note

Some states provide limited civil-liability protection for people who render aid voluntarily and without compensation. Such protections vary widely, are limited, and may not apply to many tasks here. Do not assume any such protection applies.

14. Governing law; changes; acceptance

These Terms are governed by the laws of the state in which ServiceIQ operates [to be finalized by counsel]. We may update these Terms; continued use constitutes acceptance. By creating an account, opting in to help, requesting help, or otherwise using the Service, you acknowledge you have read, understood, and agree to these Terms, the Release, and the Indemnification above.
